The Making of the Commercial Framework

The technology industry has always required significant depth of collaboration across enterprises to deliver the maximum benefit to end solutions. The making of the ODCA Commercial Framework Master Usage Model is an example of intense collaboration across enterprises.

During 2011, the Regulation and Ecosystem working group defined the problem statement and delivery scope in response to a clear mandate expressed by ODCA member organisations. The working group consisted of an enthusiastic mix of team members, competent in architecture, cloud service provisioning, deployment and consulting, procurement, law, risk management, information security, and technology transformation

A core design decision made early on was to focus on universal set of common concerns impacting the definition, management and governance of commercial contracts (called as "drivers" within the Commercial framework). The drivers were selected by research of core regulatory constructs and core business requirements across representative regions, industry segments, and legal mandates. Each driver was analysed in order to construct a contract framework including motivation for the driver, risk management considerations, pre-contractual requirements, contractual considerations, monitoring processes, and clarity around roles and responsibilities across the parties in a contract.

Leveraging the enthusiasm and expertise across the globe required intense weekly teleconferences across challenging time zones, and long working days and weeks. Solving real cloud computing challenges requires dedication, and I am appreciative of the collaboration across a global think tank. Pankaj holds qualifications in Finance (Citicorp Finance Professional), Strategy and Innovation (MBA), Software Technology (Post Graduate), and Information Systems Audit (CISA).

Pankaj chairs the ODCA Regulation and Ecosystem working group.
